Inland vs. Outland Spousal Sponsorship: Which Pathway Is Right for You?

Choosing between what is commonly called Inland and Outland spousal sponsorship can affect your options while the application is being processed.

What Is Inland Spousal Sponsorship?
"Inland" generally refers to sponsorship under the Spouse or Common-Law Partner in Canada Class.
This pathway is designed for eligible couples living together in Canada. One significant advantage is that an eligible sponsored spouse or partner may be able to apply for an open work permit while their permanent residence application is being processed.
This can allow couples to remain together in Canada while the sponsored person works legally, provided the applicable eligibility requirements are met.
However, applicants should also consider their temporary resident status and any international travel plans while the application is pending.
What Is Outland Spousal Sponsorship?
"Outland" generally refers to sponsorship through the Family Class.
It is commonly used when the sponsored spouse or partner is living outside Canada, but being physically present in Canada does not necessarily prevent a couple from using the Family Class.
This pathway can be particularly important for couples who expect international travel or who are currently living in different countries.
Another important distinction is appeal rights. If a Family Class spousal sponsorship application is refused, the sponsor may have a right of appeal to the Immigration Appeal Division, subject to the applicable rules. IRCC confirms that this appeal route is not available for refusals under the Spouse or Common-Law Partner in Canada Class.

- If Refused: The sponsor may have a right of appeal to the Immigration Appeal Division, subject to applicable rules.
- Processing Time: Varies by individual application.
There is no universally "better" option. The right pathway depends on where you are living, your immigration status, employment needs, travel plans, and the circumstances of your relationship.
Can My Spouse Work While Waiting for PR?
Possibly.
A spouse, common-law partner, or conjugal partner being sponsored for permanent residence may be eligible for an open work permit if they are living in Canada with their sponsor and meet IRCC's other requirements.
Generally, the permanent residence application must have been accepted for processing and an Acknowledgment of Receipt (AOR) issued before the open work permit application is submitted. Limited exceptions may apply where temporary status is close to expiring.
Importantly, submitting a spousal sponsorship application does not automatically give someone permission to work in Canada. The sponsored person must have valid authorization to work.
How Long Does Spousal Sponsorship Take?
There is no single processing time that applies to every spousal sponsorship application.
Processing can depend on factors such as whether the application is complete, how quickly IRCC can verify the information provided, whether additional documents or an interview are required, and application volumes.
Rather than choosing Inland or Outland based solely on an estimated processing time, couples should consider which pathway best protects their ability to live, work and travel while waiting for a decision.
How Do You Prove Your Relationship Is Genuine?
Whether you apply Inland or Outland, IRCC must be satisfied that your relationship is genuine and was not entered into primarily to obtain immigration status.
Depending on your circumstances, supporting evidence may include:
- marriage certificates or proof of common-law status;
- photographs throughout the relationship;
- joint leases, property records or utility bills;
- joint bank accounts, insurance or other shared finances;
- travel records and evidence of visits;
- correspondence or communication history; and
- other evidence showing how you have combined your lives.
The goal is not simply to submit as many documents as possible. Your evidence should tell a clear, consistent and credible story of your relationship.
Which Spousal Sponsorship Pathway Is Right for You?
Choosing Inland or Outland sponsorship can affect more than where your application is processed. It can influence your work options, travel plans, immigration status and options if the application is refused.
