Humanitarian and compassionate

H&C: for situations no standard program covers.

When no regular pathway applies, an H&C application asks IRCC to grant permanent residence based on your circumstances. The record you build decides the outcome. We will tell you your realistic odds before you retain us, including when another route gives you a better chance. If you have a removal date, call (437) 800-1918 rather than filling in the form. An H&C filing does not pause a removal on its own.

Overview

A discretionary path, built on your story.

Humanitarian and compassionate applications are discretionary. There is no checklist that guarantees approval. Officers weigh your establishment in Canada, the hardship of leaving, and the best interests of any children affected. These files are won on evidence and presentation, and they are usually a one shot application. The authority to grant it comes from section 25(1) of the Immigration and Refugee Protection Act, and IRCC publishes its own guidance on how officers apply it.

What officers weigh

The factors that decide H&C cases.

  • Your establishment in Canada: work, community, language, and family
  • The hardship you would face if forced to leave
  • The best interests of any children directly affected
  • Your immigration history and how you came to be in Canada
  • Medical needs and conditions in your home country
  • Support letters and documentary evidence that hold up to scrutiny

How we work

A lawyer-led process, with our own software doing the assembly.

01

Initial consultation

Tell Josh what you are dealing with. You get legal advice on your actual situation, written next steps, and a flat fee for the work, before you commit to anything. We quote after we diagnose, never before.

02

Building the record

You work in our secure client portal to gather and organise the evidence. Our software handles the assembly and cross-checks the file against itself, which is why a lawyer reading every page personally still fits inside a flat fee.

03

A licensed Ontario lawyer reviews and files

A licensed Ontario lawyer reviews every page before it is filed.

Flat fees. Once you are a client, a reply within one business day. No surprises.

What to know

How these cases are won.

  1. 01

    An exception, not a program

The law lets IRCC grant permanent residence to someone who does not qualify under any program, where refusing them would be unjustified in the circumstances. Officers treat it as the exception it is. The bar is real, and so is the discretion.

  2. 02

    Who this route is for

People without status, people whose other applications failed, and people whose situations simply do not fit a category. It is usually the route of last resort, which is exactly why it has to be done well.

  3. 03

    Your roots in Canada

Establishment means how rooted your life here is: years in Canada, work history, tax filings, language, community involvement, and family. It is built over time and proven with documents, not adjectives.

  4. 04

    What leaving would cost

Hardship is what returning would actually mean: separation from family, medical care that does not exist at home, discrimination, or conditions in your country. General claims fail. Specific, evidenced ones can succeed.

  5. 05

    The children in the picture

Officers must weigh how the decision affects any child involved, Canadian or not. School records, medical needs, and the child's ties are often the strongest part of a file.

  6. 06

Why there is no second draft

A refused H&C has no appeal, only judicial review at the Federal Court. Only a lawyer can appear for you there, which is one reason the choice of representative matters more on an H&C than on a routine application. That reality shapes how we prepare: the record we file is built to win, and built to stand up to review if it must.

Why us

Why work with us on your H&C?

The strongest possible record

H&C files are decided on paper. We build a complete, organized, and persuasive record of your life in Canada.

An honest case assessment

We tell you up front whether H&C is your best route, or whether another program gives you better odds.

One chance, taken seriously

A refused H&C is hard to redo. We prepare yours like the one shot it usually is.

Lawyer drafted submissions

Legal submissions tie your evidence to the factors officers must consider, so nothing is left to inference.

Ask a question
How long does H&C take?
IRCC publishes the posted processing time for H&C applications on its processing times page, and it moves. Our IRCC processing times guide tracks it. In practice we commonly see two to three years. A strong file cannot rush IRCC, but a weak one guarantees a bad outcome at the end of the wait.
Can I work while it is pending?
Only if you separately qualify for a work permit. We assess what status and permits can be maintained alongside the application.
Who qualifies?
There is no eligibility checklist. Officers weigh establishment, hardship, and the interests of any children affected. The question is whether your facts, properly evidenced, are compelling.
Does an H&C application stop my removal?
No, not by itself. A pending H&C does not pause enforcement, which is why timing, and where needed a deferral request or stay motion, matters so much. If you have a removal date, call rather than filling in a form.
Can I apply from outside Canada?
H&C applications can be made from abroad, but most are made by people already in Canada. The strategy differs, and we advise on both.
Will you tell me if H&C is not my best option?
Yes, and often we do. H&C is a last resort by design, and for some people another program, a reapplication, or a judicial review of an earlier refusal gives better odds. You will hear that on the first call, before any work starts.

Josh was incredibly helpful throughout two work permits and our overall immigration process, guiding all of us (including two different employers) every step of the way. He made complicated immigration topics easy to understand and helped us choose the best strategy for our family's needs. Now we're proud Canadian citizens raising our two kids in Montréal.
